Insurance Fraud in Canada: Challenges and Countermeasures

Following are a few key points that depict how Canada is tackling challenges related to insurance fraud:

1. The Rule-based International Order (RBIO) is supported by Canada. The state behavior in cyber space is moderated by RBIO. A framework has been created by putting in multilateral efforts by Canada.

2. The application of international law in cyberspace is reinforced by Canada. Essential parameters will be provided by international law for the state's behavior in cyberspace and this will in turn help ensure global security and stability.

3. The national views need to  be developed and published by other states. Statements are being issued by states on their national views. This follows the state's reflection on the views, several years of intensive consultations and also participation in formal and informal processes with other key stakeholders and states.

4. Capacity-building on international law application is strongly advocated by Canada. The participation of the wider possible group of states is done effectively in addressing these important questions. The insurance industry of Canada has considerable potential.

The countermeasures:

1.  Canada believes that countermeasures can be used for internationally wrongful acts. The limits in the right to take countermeasures are defined by the customary international law of state responsibility. Compliance can be induced by countermeasures. The use of threat of force should not be constituted. The peremptory norms of international law should be taken into consideration and they must be proportional.

2. Detailed information is not provided by a state taking countermeasures. There should also be reasonable grounds for the state to believe that an internationally wrongful act has been committed. The procedural aspects of countermeasures should have a precise scope. The state practice should define the specific notification given the unique nature of cyberspace.

3. The injured state can request assistance. For example, internationally wrongful cyber acts are not responded by the injured state as they do not have the legal or technical expertise. The Insurance industry Canada uses a concept known as "collective cyber countermeasures."
